Terms of Service

  1. By commissioning me (Keingå), you (the client) agree to the following terms and conditions.

  2. These terms are subject to change. Changes to these terms will not apply to commissions made prior to said changes unless otherwise discussed. Alterations to these terms must be negotiated prior to payment.

  3. Violating these terms may result in you being added to a denylist. Other artists may also be notified in the case of more egregious behaviour.

  4. Special offers (such as YCH, auctions, or themed specials not listed in the commissions sheet) may entail additional terms and conditions that take precedence over these. Be sure to read the entirety of the post in which these offers are made.

  5. If clarification is required on any terms or if you have further questions, please contact me on Twitter or Discord before submitting a commission request.

Commission Policies

  1. All commission requests are ultimately judged on a case by case basis. These policies are subject to change.

  2. I will not depict scenes or characters promoting bigotry, racism, hate, discrimination or intended to insult, distress or otherwise cause harm.

  3. I will not depict excessive violence, gore, self-harm or other demeaning scenes.

  4. I will not work off of text-only character descriptions: commission requests must include character references.

  5. I will not draw anything that is considered illegal in my or your current country of residence.

  6. If you are unsure whether I will draw your commission, feel free to ask!

  7. I reserve the right to evaluate the complexity of the commission request and apply an additional complexity surcharge at my own discretion. If I determine that the complexity of your commission request warrants a surcharge, you will be informed of this before I begin working on the commission.

  8. If any part of your commission is determined to be beyond my skill level, we may discuss options for how to best achieve your commission goals while keeping my limitations in mind, including but not limited to simplifying, obscuring or excluding the relevant elements.

Best Practices

To minimise confusion and ensure that you get what you want, consider the following suggestions and best practices when submitting your commission request:

  1. Always include visual references, even if they are just results from image searches. If you expect me to source references myself, I may get very different results compared to what you had in mind.

  2. Commission requests that have basis in existing works (e.g. emotes, drawovers, etc.) must include the original work as part of the commission requests as a reference.

  3. If possible, include a basic sketch or reference of the pose(s) that you have in mind when commissioning full art pieces. When describing details in text, bulleted lists are preferable to large blocks of text.

  4. If there are any special aspects about your character that you would like to see highlighted, make sure to emphasise this in our communications.

  5. Let me know if you require or prefer the commission to have a specific aspect ratio or resolution.

  6. Let me know if you have a deadline for this commission so that I can confirm my ability to fulfill it. If the deadline would require me to displace other pending work in the commission queue, I reserve the right to charge an additional rush fee. Please be prepared to respond promptly to any updates, questions or requests for feedback to minimise delays.

Prices and Payment

  1. All prices listed are in United States Dollars (USD) and may be subject to change.

  2. Square is my preferred means of payment. A Square account is not required to receive invoices.

  3. After the work is completed, I will send you an invoice for the agreed-upon amount. You must provide a current email address that the invoice can be issued to.

  4. After I contact you and confirm the commission terms and price, the price of your confirmed commission will not be affected by any future price changes.

  5. Any transfer fees will be covered by me.

  6. Any payment over the invoiced amount will be considered a tip. Thank you!

  7. I reserve the right to determine the final price of any work regardless of posted information.

  8. I will endeavour to be flexible with payment options and scheduling - I understand if payment may be delayed due to paycheque issues or budgetary constraints. If you foresee any delays in payment following completion of the work, please notify me of such and we can agree on modified payment scheduling.

  9. - Should the commission not be paid within one week of completion and barring any negotiated payment scheduling, it will be cancelled. Previous cancellations may be taken into account when determining whether future commission requests will be accepted.

Refunds and Cancellations

  1. I reserve the right to decline any commission at any time without explanation.

  2. If your commmission is declined after payment is received for any reason, I will endeavour to provide a refund up to the full value paid.

  3. You may cancel your commission before it is completed. You will receive a full refund if I have yet to start working on your commission - otherwise, you will receive a partial refund.

  4. All partial refunds are valued at my own discretion based upon my commission prices at the time the commission was paid for.

  5. If I charged a rush fee for a commission with a tight deadline and failed to meet that deadline, the rush fee will be fully refunded.

  6. Do NOT file a chargeback as a means to receive a refund. You must contact me such that we may settle on the terms of the refund and initiate the process. If a chargeback is filed against me without my consent:

  • You will be forbidden from requesting further commissions from me in the future.

  • You will relinquish all rights granted by me to use my work, both commercially and non-commercially.

  • All correspondence may be shared publicly and with financial institutions during dispute resolution at my own discretion.

Conduct and Process

  1. My preferred mode of communication is via Discord. When submitting your commission request, please add me at Keingå#5136 to stay informed about the status of your commission and so that I may request further information as required.

  2. I will endeavour to handle all correspondence in a respectful and courteous manner, and I humbly request that you do the same. Any ill behaviour will be taken into account and may result in me cancelling the commission (see Refunds and Cancellations)

  3. Once you submit a commission request using the request form, the following process will be implemented:

-  1)  I will contact you over Discord, Twitter or email to confirm the details and price of the commissions.
-    ◦ If I cannot reach you via at least one of these methods, the commission request will be cancelled.
-    ◦ I may also request more details about your commission as required: (see Commission Policies: Best Practices)
-  2) Once details of the commission are confirmed, I will begin working on the commission.
-    ◦ I will reach out for additional information about the commission as required and provide updates upon request.
-    ◦ I may send an initial sketch to review. You are welcome to red-line the sketch to better convey your desired product.
-    ◦ I may occasionally send WIPs to show progress and solicit feedback: only minor edits may be made after this point.
-  3) Once complete, the artwork will be shown to you for final review.
-    ◦ This is your last opportunity to request minor edits; refunds are no longer offered at this point.
-  4) Unless negotiated otherwise, I may now upload the work to my online websites and galleries.

  1. If I make a mistake due to misinterpreting your commission request, I will take full responsibility and correct the error - please don't hesitate to point out any such misunderstandings on my part, as well as any other errors, anatomical or otherwise. I reserve the right to decline or charge an additional fee if an edit is deemed unreasonable or significantly beyond the scope of your original request.

  2. I will endeavour to be transparent about delays, and feel free to contact me if you are concerned that I am taking longer than expected. However, please keep such inquiries regarding progress and pacing reasonable - I reserve the right to adjust the terms of the commission as required.

  3. When contacting me, please keep in mind that I am located in the Pacific time zone (PST; GMT-8.00).

  4. If I contact you for additional information and do not receive a response in over a week, I will continue to work with the best information given and my best assumptions and judgment on the work. In this circumstance, I will refuse to make any major edits to the work that would have otherwise been resolved by receiving additional information in a timely manner.

Rights to Use My Work

  1. By commissioning me, you are paying for the time, resources, tools and skills used for creating your artwork, and not the artwork itself or anything depicted therein. You may purchase the copyright or any additional rights from me separately at a significantly increased price.

  2. Unless otherwise stated by me, the following permissions and restrictions apply to anything I create at the time of creation, and updates to these terms do not apply to previous creations.

I, the artist...

  • ...may distribute my work freely and at my own discretion.

  • -  ◦ You may request that I not share the work for up to 2 months following receipt of payment.

  • -  ◦ You may request that I retain the work privately indefinitely, for an additional fee.

  • ...may use my work for commercial purposes, unless you purchase those rights from me - in which case I shall NOT do so.

  • ...shall NOT claim your characters or ideas as my own.

You, the client...

  • ...may share WIPs during the commission process privately with others.

  • -  ◦ * The rights that follow do NOT apply to WIPs unless I expressly indicate and agree to such. Please feel free to contact me for permission.

  • ...may repost my work on the condition that it is posted with credit or is otherwise attributable to me, with a minimum of my name (Keingå) and a link directing to one of my profiles or galleries. If formatting or platform limitations prevent such, the "å" within my name may be replaced with a standard "a".

  • ...may crop and resize my work for use as a personal avatar without credit.

  • ...may crop and resize my work for use as emotes on chat platforms on the condition that you provide credit when asked.

  • ...may use my work for badges and emotes on Twitch and other streaming platforms on the condition that credit is given to me in your channel info.

  • ...may edit my work, or have others edit my work, on the condition that you state clearly and openly that it is derivative of my work and is NOT a collaboration, and link directly to the original if it has been posted publicly by me/to my profile or galleries if the original has not been posted publicly by me.

  • -  ◦ This does NOT grant you permission to remove my signature and watermark. However, you may add your own as well.

  • -  ◦ Selling or otherwise commercialising such derivative works is strictly forbidden.

Anyone, including me (the artist) and you (the client)...

  • ...may print out my work for personal, non-commercial purposes if it does not contain my original characters or sona.

  • ...may trace my work for the sole purpose of practice. Such practice works may be posted publicly on the condition that they link directly to the original as posted publicly by me if the derivative work is ever shared.

  • -  ◦ Selling or otherwise commercialising such derivative works is strictly forbidden.

  • -  ◦ if the original is not publicly posted by me, a link to one of my profiles or galleries is acceptable as credit.

  • ...shall NOT remove or obfuscate my signature/watermark without prior permission, or take credit for creating my work. This action is considered theft and will be treated as such.

  • ...shall NOT mass-produce, sell, or otherwise commercialise items that include my work without first acquiring written permission from me and all other copyright holders who may have their intellectual property depicted in the work.

Privacy Policy

  • You may request to remain anonymous during and after the process, in which case I will use a random placeholder name if I need to publicly refer to you (e.g. referring to your slot in my queue, describing who the current commission belongs to, etc.).

  • I reserve the right to keep records for my own use, including but not limited to names, invoices, contact information and correspondence, but they will not be shared with any third party unless my terms are violated or I am required to do so by law.
